Order Acceptance

The receipt of an order number or an automated email order confirmation does not constitute the acceptance of an order or a confirmation of an offer to sell. Guitar-Online reserves the right, without prior notification, to refuse service to any customer. The sale is not completed until the order has been verified manually. Guitar-Online will confirm to the Buyer that the order has been accepted using the e-mail address that Buyer has given. Verification of information may be required prior to the acceptance of any order. The Buyer agrees that he was aware of the specific sales conditions on this screen when he made his order, and states that he accepts them without reservation. The information given by the Buyer when placing an order is their responsibility. In the event of an error in the delivery address, Guitar-Online cannot be held responsible if it is impossible to deliver the order.

Price & Currencies

Prices are established in the European currency, which is the Euro. Prices indicated in other currencies (USD, GBP, AUD, CAD, YEN, FRS) are only indicative and vary according to daily exchange rates fluctuations. To get an accurate conversion to your currency please use the XE.com Quick Currency Converter at www.xe.com.

We are able to accept payments by all major credit cards, wire transfer, PayPal®, Postal Money Orders and Western Union®.

The price shown in Euros on the order confirmation is the final price and it will not be subject to change. This price includes the product price, handling, packaging and delivery costs (where applicable).

If you use “Postal Money Order” or “Western Union® transfer” as mean of payment, you will have to bear all the fees that your Post Office, Western Union® or their agents may charge for their service.

Delivery

Delivery times are only indicative:

  • approximately 24 to 48 hours for the versions without CD-ROM
  • 3 to 10 working days for the delivery of CD-ROMs inside Europe
  • 10 to 21 working days for the delivery of CD-ROMs outside Europe

The guitar courses and all software sold without CD-ROM are sent via e-mail as attached files (size of approx. 3Mb).

The delivery of the CD-ROM versions is made by “La Poste” (French Postal Service) or “Correos” (Spanish Postal Service) using Airmail Priority Service. Delivery is made within the time frame agreed with the Buyer by the product being handed directly to the addressee, or if they are absent, to another person authorized by the Buyer. The Buyer has no right to claim damages for any lateness of delivery.

Additionally, for deliveries outside Europe, the Buyer agrees to pay potential import taxes, customs duties, value added tax and all other taxes due under the laws of the country where the order is received. All orders made with Guitar-Online are for the personal use of the Buyer and the Buyer or the person receiving the order will not re-sell some or all of the products contained therein. Guitar-Online accept no legal responsibility if tax payments are not made by the Buyer.

Guitar-Online is released from its obligation to supply by reason of a force majeure which may include but is not limited to war, riot, strikes and accidents.

Data preservation – Responsibilities

For safety reasons each program is customized with the client’s data. Guitar-Online is not held to preserve any copies and the customer must ensure the good preservation of programs and data through time.

We thus advise the customer to make a backup copy of the following elements, on a reliable support:
– Installation files
– Passwords and, should the occasion arise, serial numbers
– CD-ROM (in case the customer has purchased a CD-ROM version)

Any request for recovery of lost or damaged data (program, password, serial number, replacement of a CD-ROM that the customer would have lost or damaged) would be invoiced to the customer.

Jurisdiction

This Web site is operated by Guitar-Online from its offices in Toulouse (France). The French law shall govern these terms and conditions, without reference to its choice of law rules. Guitar-Online cannot be held responsible for damage of any sort, whether actual, theoretical or personal that may result from the use of any of the products sold. If it is not possible to settle out of court, the Tribunal de Commerce in Toulouse (France) is the only competent court whatever the place of delivery and whatever means of payment is accepted.

Ownership clause

The ownership of the products sold remains with Guitar-Online until full payment has been received, including principal, shipping charges and Taxes. Shall the Buyer not fulfill his payment obligations, the Seller has the right to demand immediate restitution of the merchandise delivered at the expense and risk of the Buyer.
